Hybrid Course: Establishing Causation in Complex Claims - Follow the Evidence

 

About: 

Join us on Thursday, November 27th 2025, for "Establishing Causation in Complex Claims: Follow the Evidence” taking place from 5:30pm to 8:00pm EST at MaRS in downtown Toronto with an option to attend remotely.

All medical-legal assessments require the establishment of causation. Sometimes, determining causation is a relatively simple task. Some claimants have a pristine health history and employment record and there is little or nothing in the way of pre-existing symptomatology.  In other cases, a claimant is highly impaired prior to the index injury.  This program will be of interest to all assessors, including those providing assessments for the purpose of treatment planning and those providing assessments for Tort claims. Even when signing an OCF-18, the health care provider attests to the fact that the proposed goods are services are due to injury caused by the index accident. When performing an examination for Tort, the establishment of causation is paramount and should be explicitly described in a report.

Join us in a didactic program centered around case examples to learn:

  • What is required in order to determine causation?
  • How should causation be described in a report?
  • Can an opinion regarding causation be made without pre-accident records?
  • Can impairment due to an index injury exist when the claimant was already highly impaired prior to the index injury?
  • Is a clinician’s determination of causation different than the courts?


Speakers: 

Laura Emmett - SBA Lawyers 



Laura Emmett is a lawyer at SBA Lawyers LLP based out of the London office. She has a diverse practice where she focuses on bodily injury and accident benefits claims. Laura has set herself apart as a leader in the legal profession and insurance industry. In addition to co-authoring an annual publication of accident benefits, she is a Past President of the Canadian Defence Lawyers and was the youngest person to hold the position. She has also served on the board for the Defense Research Institute and the Ronald McDonald House Charities Southwestern Ontario. Presently, she is a Bencher for the Law Society of Ontario where she serves as the Chair of the Compensation Fund and the Vice Chair of the Audit and Finance Committee. In her free time, Laura enjoys actively checking off items from her bucket list. Highlights include hiking to see the gorillas in Uganda, swimming between the tectonic plates in Iceland, and jumping off the side of the Stratosphere in Las Vegas.

Shane Henry - Longo Lawyers 


Shane brings a calm and courteous approach to personal injury litigation. He has an inner drive that pushes him to fight to ensure that his clients reach their best result, either through settlement or trial. Shane has practiced exclusively in the area of Plaintiffs’ Personal Injury Law since his call to the bar. He has successfully represented his clients’ interests before the Ontario Superior Court of Justice, the Financial Services Commission of Ontario, the Ontario Licence Appeal Tribunal (LAT), the Workplace Safety and Insurance Board, and in Canada Pension Plan appeals.

Shane’s diverse background helps him to understand that every client has their own needs. He has previously worked in the area of dispute resolution with amateur and professional athletes. His undergraduate work in the area of Physical and Health Education allows him to recognize the importance of helping clients to achieve the best possible recovery in both their lives and their lawsuits. Shane’s ability to develop personal and professional relationships helps him to meet his clients’ needs in a timely and courteous manner.
