Clinical Fundamentals Hybrid Course & CSME AGM: When Courts Speak: Critical Rulings Every Evaluating Clinician Should Know


Overview:

Four senior legal practitioners will present and analyze the most influential and emerging decisions in LTD, WSIB, medical malpractice, and MVA litigation—cases that are actively redefining how expert evidence is evaluated, accepted, and challenged.

For clinicians, assessors, and legal professionals, these rulings have immediate and practical consequences. Courts and tribunals are increasingly explicit in their expectations regarding causation, methodology, credibility, and the formulation of expert opinion. Understanding how and why expert evidence succeeds—or fails—is now fundamental to defensible practice.

This session translates jurisprudence into actionable best practices, offering direct guidance on strengthening medico-legal reports, testimony, and litigation strategy. Participants will gain insight into judicial reasoning patterns, common pitfalls in expert evidence, and evolving standards that materially affect case outcomes.

The program also includes a focused professional development component on the strategic use of CanLII as a core competency for medico-legal practice. Jurisprudential literacy is essential for risk management, professional credibility, and informed expert opinion.

For professionals working at the intersection of medicine and law, this session is not optional continuing education but rather essential practice intelligence.
